Cynthia Matthews Daley is a partner at Daley, Koster & LaVallee, LLC. In January 2005, Ms. Daley was appointed as a Magistrate Judge in Carroll County, Georgia. Ms. Daley focuses her private practice on the areas of general litigation, governmental law, employment law, and appellate litigation.

Ms. Daley’s general litigation practice includes representing clients in premises liability, medical malpractice, D&O, personal injury and third-party claims in both federal and state courts.  Ms. Daley is an experienced trial lawyer in both federal and state courts.  In the appellate courts, Ms. Daley has briefed cases before the United States Supreme Court, United States Court of Appeals for the Eleventh Circuit, the Georgia Court of Appeals and the Georgia Supreme Court.

In Ms. Daley’s governmental practice she serves as general counsel to a school district and municipality advising them on day to day issues.  She also represents counties, cities, school districts, public hospitals, police and sheriff departments, and correctional health care entities and professionals on a wide array of claims, including First Amendment, Eighth Amendment, substantive and procedural due process, excessive force, false arrest, and false imprisonment claims under 42 U.S.C. § 1983; claims under Title II of the Americans with Disabilities Act; claims under the Individuals with Disabilities in Education Act; claims under the Individuals with Disabilities in Education Act; as well as state law claims for negligence, defamation, and breach of contract. Ms. Daley also represents private correctional healthcare entities and individuals who provide medical services for governmental entities on claims arising from the care and treatmet of inmates.  These claims range from state lasw medical malpractice to federal civil rights claims.

Ms. Daley serves as general employment counsel for numerous companies and healthcare entities providing not only day to day advice on the myriad of issues arising under both federal and state employment laws, but also in performing transition planning, training, regulatory compliance and drafting employment related documents. In addition, Ms. Daley represents both public and private employers in litigation matters arising from discrimination, sexual harassment, retaliation, and contractual claims. She also has successfully defended claims unique to public employers, including free speech, political patronage, and candidacy-related claims under the First Amendment. Ms. Daley has defended employers before federal and state trial and appellate courts, as well as before the Equal Employment Opportunity Commission, the Department of Revenue and the Department of Labor.

Ms. Daley has been named to Atlanta Magazine’s list of Georgia Super Lawyer Rising Stars on multiple occasions, an honor given to just 2.5% of Georgia attorneys annually. She has also spoken nationally on litigation issues and been appointed to the leadership for the Governmental Liability Committee of the Defense Research Institute where she serves as Program Chair and is a Vice Chair of the Tort and Insurance Practice Section of the American Bar Association's Committee on Local Government.

Ms. Daley also formerly clerked for the Honorable Justice Hugh P. Thompson of the Supreme Court of Georgia in 2001.
